Welcome to Fooder!
By accessing or using the Fooder website (“Website”), mobile applications (“App(s)”), and related services (collectively, the “Services”), you (“you” or “your”) agree to these Terms of Service (“Terms”), our Privacy Policy, and our Community Guidelines (together, the “Fooder Terms”). The Services are provided by Input: Legal Name of Company (“Fooder”, “we”, “us”, or “our”).
If you do not agree to these Terms, please do not use our Services.
- Registration, Accounts, Services
Who can use the Services
- You must be at least 18 years old to use Fooder.
- You may not use the Services or provide us with personal information if you are under 18. We take steps to prevent underage use and will delete accounts if we discover a violation.
Your Account
- You may need to register for a Fooder account to access some Services.
- You agree to provide accurate, complete, and updated information.
- Only one account per person is allowed. Do not share your account.
- You are responsible for maintaining the confidentiality of your password and all activities under your account.
- Notify us immediately at support@fooderapp.it if you suspect unauthorized use of your account.
- You may delete your account at any time, but this usually cannot be undone.
Changes to Services
- We may update, change, or discontinue any part of the Services at any time without liability.
- We may also change prices, features, or availability of the Services.
- Some features rely on third parties (e.g., grocery integrations). We are not responsible for changes by those third parties.
Changes to Terms
- We may update these Terms at any time. We will notify you of material changes.
- By continuing to use the Services after changes, you agree to the new Terms.
- If you do not accept the new Terms, stop using the Services and delete your account.
- Ownership and Use of Content
- “Content” includes all materials on Fooder, such as images, text, data, recipes, meal plans, software, and more.
- “User-Generated Content” means any content you or other users provide (e.g., food logs, comments, photos).
- “Fooder Content” means all content not provided by users.
Our License to You
- We grant you a limited, personal, non-transferable, non-exclusive license to use the Services for personal, non-commercial purposes.
- You may not copy, modify, reverse engineer, sell, or otherwise exploit Fooder Content unless expressly permitted.
Your License to Us
- By posting User-Generated Content, you grant Fooder a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content in connection with the Services.
- You confirm you have all necessary rights to your User-Generated Content, and that it does not infringe any third-party rights.
- We may moderate, remove, or restrict User-Generated Content at our discretion.
- Premium Services
- Fooder may offer paid premium features (“Premium Services”).
- By signing up, you agree to pay all applicable fees.
- Subscriptions renew automatically unless cancelled before the end of the billing period.
- You may cancel via your account settings or the app store where you subscribed.
- Free trials may be offered; if not cancelled, you will be charged at the end of the trial period.
- All purchases are final except where required by law or at our discretion.
- We may change prices with reasonable notice.
- Health and Safety
- Fooder provides general nutrition and wellness information only. We do not provide medical advice.
- Always consult a qualified healthcare provider before making changes to your diet or exercise.
- You are solely responsible for managing allergies and dietary needs.
- Use of the Services is at your own risk. We do not guarantee the accuracy or safety of any content, including user-contributed food data.
- Fooder is not liable for any health outcomes related to use of the Services.
- Restrictions
You may not:
- Use the Services for unlawful purposes.
- Copy, modify, distribute, or create derivative works from Fooder Content except as allowed.
- Use the Services for commercial purposes without our written consent.
- Disrupt, attack, or interfere with the Services or other users.
- Use automated tools (e.g., bots, scrapers) to access or collect data from the Services.
- Upload viruses or malicious code.
- Harvest or collect personal data about other users without consent.
- Third Parties
- The Services may link to or integrate with third-party services (e.g., social media, health devices).
- Use of third-party services is at your own risk and subject to their terms and privacy policies.
- Fooder is not responsible for third-party content, products, or services.
- Intellectual Property
- All intellectual property rights in Fooder Content and the Services are owned by Input: Legal Name of Company or its licensors.
- You may not use our trademarks, logos, or branding without our written permission.
- If you believe your copyright or trademark has been infringed, please contact us at Input: Copyright/Legal Email or Address.
- No Warranties
- The Services are provided “as is” and “as available.”
- We do not guarantee that the Services will be error-free, uninterrupted, or accurate.
- To the extent permitted by law, we disclaim all warranties, express or implied.
- Limitation of Liability
- To the extent permitted by law, Fooder is not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill.
- Our total liability for any claim is limited to the greater of €500 or the amount you paid us in the last 12 months.
- Some jurisdictions do not allow certain exclusions or limitations, so these may not apply to you.
- Indemnification
- You agree to indemnify and hold Fooder harmless from any claims, losses, or damages arising from your use of the Services, your User-Generated Content, or your violation of these Terms.
- Governing Law
- These Terms are governed by the laws of Italy and the European Union, without regard to conflict of law principles.
- Any disputes will be subject to the exclusive jurisdiction of the courts of Input: Your City/Province, Italy.
- Dispute Resolution
- You agree to first contact us to resolve any dispute informally.
- If a dispute cannot be resolved, you may have the right to bring a claim before the competent court in your jurisdiction.
- Nothing in these Terms limits your rights under applicable consumer protection laws.
